Louisiana Court Shields Off-Road Diesel From Local Tax
The Louisiana Supreme Court refused to reconsider a ruling that prevents local governments from taxing diesel fuel used to power off-road equipment, the Associated Press reported. The Sept. 8 decision put off-road diesel in the same category as motor fuel, which cannot be taxed by local governments under the state’s constitution, AP said. Local governments have said off-road diesel should not be treated like a motor fuel because it has a flash point higher than 110 degrees.
The court had ruled in July that local governments could not tax so-called "dyed" diesel, which is diesel fuel containing red dye that shows it is to be used to fuel generators and various other pieces of off-road equipment. Transport Topics
