Kentucky Carrier Drops Overweight Truck Suit
Kentucky trucking company has dropped its lawsuit challenging a state law that allows overweight coal trucks on state roads but not trucks carrying other materials, the Associated Press reported.
The suit, filed in 2004 against Kentucky’s Justice and Public Safety Cabinet, had been inactive for months and was set for automatic dismissal in coming weeks, AP reported.
An attorney for D.R.T. Trucking admitted the suit was aimed at pressuring the state’s General Assembly to pass a bill last winter that would have expanded the coal industry's weight exemption, so trucks hauling gravel, sand and other minerals also could haul 60 tons, AP said.
